Takedown Notice Policy

Submitting a Counter-Notice: If you believe that material you posted on the Website was removed or access to it was disabled by mistake or misidentification, you may submit a written counter-notification (“Counter-Notice”) to our designated copyright agent containing the following information:

  1. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled.
  2. A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  3. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or if you are located outside the United States, that you consent to jurisdiction of any judicial district in which the service provider may be found), and that you will accept service of process from the person who provided notification under DMCA subsection (c)(1)(C) or an agent of such person.
  4. Your physical or electronic signature.

Policy Enforcement: Upon receipt of a valid Takedown Notice, NeighborhoodCinema.com will promptly remove or disable access to the allegedly infringing material. We will also notify the user who posted the material of the removal or disabling of access. If the user believes the material was removed or disabled by mistake, they may submit a Counter-Notice.

Upon receipt of a valid Counter-Notice, NeighborhoodCinema.com will promptly provide a copy of the Counter-Notice to the original complainant and reinstate the removed material or cease disabling access to it, unless we receive notice within 10 business days that the original complainant has filed an action seeking a court order to restrain the user from engaging in infringing activity related to the removed material.

Repeat Infringers: NeighborhoodCinema.com reserves the right to terminate access to the Website by users who are repeat infringers.
